Tuition Protection Service and other measures

A number of changes to the Education Services for Overseas Students Act 2000 were enacted on 20 March 2012 as part of the Government's second phase response to the Baird Review. The changes will commence from 1 July 2012.
 
The Education Services for Overseas Students Legislation Amendment (Tuition Protection Service and Other Measures) Act 2012
 
The Education Services for Overseas Students (Registration Charges) Amendment (Tuition Protection Service) Act 2012
and
The Education Services for Overseas Students (TPS Levies) Act 2012.

What do I need to do to comply?

Information on what education providers need to do to comply with the changes can be found in the following PowerPoint presentation, notes, legislative checklist, provider brochure and FAQs. This is the same information that was made available to education providers during information sessions held in major capitals during April and May 2012.
 

Information sessions

14 provider information sessions on the new Tuition Protection Service (TPS) legislation were held for education and training providers registered on the Commonwealth Register of Institutions and Courses for Overseas Students during April and May 2012. The purpose of the sessions was to inform providers:
  • of the objectives of the Government's reforms and amendments to the ESOS Act and
  • what they need to do to comply.
Sessions were held in all major capital cities (Sydney, Melbourne, Brisbane, Canberra, Perth, Adelaide and Hobart).
 
If you were not able to attend a session, please refer to the information made available at each session below.
 
Presentation
This PowerPoint presentation was used at the information sessions and gives a broad overview of what providers need to do to comply with the legislation.
 
Notes from speakers
These speaking notes were used by presenters at the information sessions and give detailed information about what providers need to do to comply with the legislation.
 
Legislative checklist
This checklist provides references to the relevant sections of the legislation that have been amended or relate to the amendments, to assist providers to understand their obligations and penalties that apply for non-compliance.

Consultative Committee

A TPS Implementation Consultative Committee has been operating to provide a forum for ongoing communication between the Government and international education sector to support the smooth transition to the new TPS arrangements. The Committee will meet on a monthly basis in the lead up to implementation of the TPS reforms and includes the following international education sector peak bodies:
  • Australian Council of Private Education and Training (ACPET)
  • English Australia (EA)
  • the Council of Private Higher Education (CoPHE)
  • Independent Schools Council of Australia (ISCA)
  • TAFE Directors Australia (TDA)
  • Universities Australia (UA)
  • the Council of International Students Australia (CISA)
