Vietnam’s legal framework differs substantially from that of Australia.  To assist education institutions that are considering operating in Vietnam, AEI Vietnam has compiled a guideline document that summarises the laws, regulations and decrees that affect the delivery of foreign education in Vietnam.

 

The Overview of the Legal Framework Affecting the Provision of Foreign Education in Vietnam (PDF, 357 KB) (RTF, 245 KB) outlines the basic information about the country’s legal structure, including the role of the National Assembly, Government Ministers and government departments responsible for the administration of Education and Training. The legal instruments for education and VET delivery are also summarised for non-profit and commercial education institutions.

 

Foreign investment in education is governed by a range of laws, including those relating more generally to business investment and workplace relations. The paper provides an overview of the laws in Vietnam relating to 100 percent Foreign Owned Institutions, Joint Ventures, Business Cooperation Contracts and those relating to establishing representative offices in Vietnam.  A number of examples are provided.
